رویکرد فقه و سیاست کیفری ایران نسبت به قتل های ناموسی؛ چالش ها و راهکارهای پیشگیری

چکیده
قتل های ناموسی یکی از معضلات اجتماعی و ازجمله اشکال خشونت شدید علیه زنان در برخی شهرهای ایران است که آثار مخرب روانی، فرهنگی و اجتماعی زیادی به دنبال دارد. در این مقاله به بررسی این سؤال پرداخته شده است که رویکرد فقه و سیاست کیفری نسبت به قتل های ناموسی چگونه بوده، چالش ها و راهکارهای پیشگیری از آن چیست؟ مقاله حاضر توصیفی تحلیلی بوده و با استفاده از روش کتابخانه ای به بررسی سؤال مورداشاره پرداخته شده است. یافته ها حاکی است که نوع و میزان مجازات تعیین شده برای عاملان قتل های ناموسی که با معاذیر مخففه همراه می باشد از مهم ترین تأثیرات قوانین کیفری در افزایش میزان وقوع این نوع قتل ها است. از این رو بازنگری مجدد این احکام و مقررات قانونی می تواند تأثیر فراوانی در بهبود نحوه برخورد و مواجهه با قتل های ناموسی و مرتکبان آن ها داشته باشد. از طرفی، یکی از مباحث مهم در علل وقوع این پدیده بحث فرهنگ جامعه است. بایستی فرهنگ حمایت و حفاظت از زنان و کودکان در جامعه از طریق نهادهای آموزشی مانند مدارس و رسانه ها تقویت شود.The Approach of Jurisprudence and Iranian Criminal Policy toward Honor Killings: Challenges and Prevention
Honor killings are one of the social problems and one of the forms of severe violence against women in some cities of Iran, which has many psychological, cultural and social destructive effects. In this paper, the question is: “what is the approach of jurisprudence and criminal policy toward honor killings has been, what are the challenges and solutions to prevent it?”. This paper is descriptive and analytical, and the mentioned question has been investigated using the library method. The findings indicate that the type and amount of punishment for the perpetrators of honor killings that are accompanied by the mitigating excuse are the most important reasons for the increase in the occurrence of these murders. Therefore revision of these legal rulings and regulations can have a great impact in improving the way of dealing with honor killings and their killers. On the other hand, one of the important issues in the causes of this phenomenon is the culture of society. The culture of support for women and children in society must be strengthened through educational institutions such as schools and the media.
