چکیده
یکی از مهم ترین چالش های ایجاد شده در طول سال های اخیر، چگونگی حفاظت از محیط زیست در برابر اقدامات و عملیات نفتی است. با عنایت به آثار مخرب ناشی از این عملیات، نهادهای مسئول این صنعت در تلاش اند به منظور کاهش ریسک های زیست محیطی اصل پیشگیری را بر درمان اولویت بخشند و بر اقدامات پیشگیرانه تاکید کنند. این پژوهش به شیوه ی توصیفی تحلیلی بر آن است تا از طریق واکاوی الزامات و اقدامات پیشینی پیمانکار در قانون و قرارداد و تبیین ماهیت ضوابط زیست محیطی از طریق ارجاع به قوانین و مقررات ملی زیست محیطی، ارجاع به رویه های بین المللی و استانداردهای بین المللی و ارجاع به روش قانون ملی و رویه های بین المللی، همچنین اقدامات قانونی و شروط قراردادی ازجمله مطالعات امکان سنجی، ضوابط مرتبط با مناطق حفاظت شده، اقدامات مقتضی در شرایط اضطراری، مدیریت پسماند و پاک سازی، بیمه و شروط ضمنی قراردادی از جمله تنظیم و رعایت کدهای زیست محیطی، ساز و کارهایی موثر بر کاهش روند آلودگی ها ارائه گردد.analysis Previous actions of the contractor to reduce environmental risks in upstream oil contracts

This research, in a descriptive and analytical manner, aims to analyze the requirements and previous measures of the contractor in the law and contract and explain the nature of environmental regulations by referring to national environmental laws and regulations, referring to international procedures, and international standards. International and international standards and references to national law and international procedures, as well as legal measures and explicit and implicit contractual terms, including feasibility studies, regulations related to protected areas, appropriate measures in emergency situations, waste management, and cleaning, and insurance, provide effective mechanisms to reduce pollution trends.
