چکیده
پیشرفت روزافزون فناوری اطلاعات و افزایش کاربری آن در زندگی روزمره علاوه بر بهبود کیفیت حیات از طریق استفاده مشروع، موجب لطمه به جامعه نیز می شود. فضای سایبری که از دستاوردهای فناوری اطلاعات می باشد بستر تحولات مختلف حقوقی - مالی را فراهم آورده است. ارزهای رمزنگاری شده یا دیجیتال که از عمر آن ها چند سالی بیش نمی گذرد، طی سال های اخیر به صورت گسترده مورد استفاده قرار گرفته اند. امروزه با مطرح شدن رمزارزهایی نظیر بیت کوین در کشورهای مختلف و استفاده گسترده از آن ها توسط مردم، ابهامات متعددی در مورد ماهیت آن ها مطرح شده است و پذیرش رمز ارزها و پول مجازی، با موافقان و مخالفانی داشته که هریک برای اثبات نظر خود به دلایل متعددی اشاره می کنند. از سوی دیگر، با توجه به نو بودن این پدیده، نقش تنظیم گری دولت ها در این حوزه جدید، قابل توجه و مهم می باشد و با توجه به تکلیف دولت ها در خصوص تامین امنیت اقتصادی شهروندان و نیز حمایت از حقوق اساسی اشخاص، دخالت دولت در این حوزه جدید، امری ضروری است. روش تحقیق در این پژوهش از نوع توصیفی-تحلیلی است و در گردآوری منابع از روش کتابخانه ای استفاده شده است.Legal pathology of government regulation in the field of cryptocurrencies

Today, with the introduction of cryptocurrencies such as bitcoin in different countries and their widespread use by the public, many ambiguities have been raised about their nature, and the acceptance of cryptocurrencies and virtual currency has had pros and cons, each of which to prove They point out their opinion for several reasons. On the other hand, due to the novelty of this phenomenon, the regulatory role of governments in this new area is significant and important, and due to the duty of governments to ensure the economic security of citizens and protect their rights. Individuals, government intervention in this new area, is essential. The research method in this research is descriptive-analytical and library method has been used in collecting resources.
