روش شناسی تأصیل اصول حاکم بر خانواده با تطبیق بر روش «اکتشاف» شهید صدر (مقاله علمی وزارت علوم)

چکیده
بررسی هایی که تا کنون درخصوص اصول حاکم بر خانواده صورت گرفته، اغلب پیرامون تبیین مصادیق بوده است، بدون اینکه مفهوم اصل، حکومت و روش استنباط این اصول از آیات و روایات تبیین شود. از آنجا که هر استنباطی نیازمند تبیین روش است، در این پژوهش، بر آنیم تا با تطبیق مبانی و استفاده از قواعد و اصول روش «اکتشاف» شهید صدر در کتاب «اقتصادنا»، که نظریه نوینی در ارائه مکتب اقتصادی محسوب می شود، به تبیین روش ها و سازوکارهای استنباط اصول حاکم بر خانواده از آیات و روایات با روش توصیفی تحلیلی بپردازیم. مهم ترین سازوکارهای روش اکتشاف که در این تحقیق بررسی می شوند، عبارت اند از: تکرار و تأکید شارع، خطابات جمعی در استعمال الفاظ عام، کشف ملاکات احکام و روش استقرا. اعتبارسنجی ابزارهای این استنباط در حوزه خانواده، موجب اعتباردهی بیشتر به اصول مکتشف می گردد که این اصول امروزه در سیاست گذاری ها، قانون گذاری و اجرا در مسائل فقهی حقوقی خانواده بسیار مورد توجه اند؛ زیرا اولاً روش اجتهاد اصولیان با حفظ چارچوب سنتی نیازمند توسعه و تکامل است و باید علاوه بر قواعد اجتهادی که عمدتاً ناظر به جنبه های فردی است، به روش دستیابی به احکام اجتماعی و فقه حکومتی و احکام مستنبط از گزاره های اخلاقی نیز توجه شود؛ ثانیاً این اصول جهت گیری کلان یک نظام را نشان می دهد و به جای بیان یک حکم و شناخت جزءجزء آنها، از چیستی یا چرایی احکام سخن می گوید و در صورت تعارض با تک گزاره ها، بر آنها حاکمیت دارد.Methodology of Compiling the Principles Governing the Family by Adopting the Method of "Exploration" of Shahid Sadr
The researches that have been carried out so far regarding the principles governing the family, have often been about adoting of exapless, without explaining the concept of the principle, government and the method of deriving these principles from the verses and traditions. Since every inference requires an explanation of the method, so in this research, we intend to adopt the bases and principles of the method of "exploration" of Martyr Sadr in the book "Our Economy" which is a new theory in the presentation of the school that is considered as economic school, to explain the methods and mechanisms of deriving the principles governing the family from verses and tradtions by using the descriptive- analytically mehod.The most important mechanisms of the exploration method examined in this research are: repetition and emphasis of the law, collective speeches using common terminology, discovering the criteria of rulings, and induction method. The validation of the tools of this inference in the field of family will give more credit to the discovered principles which are of great interest today in policy-making, legislation and implementation in jurisprudential-legal issues related to family. This is because first of all, the method of Ijtihad of the Usulians requires development and evolution while maintaining the traditional framework, and in addition to the rules of Ijtihad that mainly focus on individual aspects, attention should also be paid to the method of obtaining social rulings and governmental jurisprudence as well as rulings derived from moral propositions. Secondly, these principles show the macro approach of a system and instead of expressing a ruling and knowing its segments, it staes and discuses about what or why the rulings are, and in case of conflict with individual propositions, it can have authority over them.
