چکیده
جرم سبز به عمل دائمی یا موقّتی یا روندی گفته می شود که تأثیر منفی بر محیط زیست، سلامتی افراد یا منابع طبیعی دارد و هرگونه فعل زیان آور به محیط زیست اعمّ از طبیعی و انسانی محسوب می گردد. در دین اسلام در کنار فرامین عبادی، در زمینه بهداشت و لزوم محافظت از محیط زیست نیز تعلیمات فراوانی به چشم می خورد. گذشته از این که برخی نهادهای فقهی نظیر انفال، حسبه و مالکیّت دربرگیرنده ملاحظات محیط زیستی هستند دستورات و نیز تعلیمات دین اسلام در مورد رعایت حقوق زیست، غالباً جنبه اخلاقی دارد اما در مبانی مختلفی نظیر آیات، روایات، و قواعد فقهی، زوایای مختلف محیط زیست و مبانی جرم شناختی جرائم به وضوح قابل تحصیل است. مطالعه تطبیقی اسناد بین المللی از یک سو، و منابع شرعی از سوی دیگر، حاکی از این واقعیّت است که با وجود توافق نامه های بین المللی متعدّد در خصوص جرم سبز و مقرّرات وسیع آن، مبانی فقهی امامیّه، هم شمول بیشتری از جرم سبز را در برگرفته و هم قواعد آن در جهت پیشگیری از وقوع جرم مذکور نسبت به سایر اسناد بین المللی مؤثّرتر بوده است. ضمن این که قابلیّت ارعاب آمیز بودن و قدرت بازدارندگی، وصفی است که مقرّرات مربوط به این حوزه در راستای کاستن از ارتکاب این جرائم باید بیش از پیش مدّنظر قانونگذار قرار گیرد.Analysis of the criminological dimensions of green crime from the perspective of Imami jurisprudence and international documents

Innocent leaders have practically encouraged these traits through their actions and behavior. It often has a moral aspect, in the principles and rules of jurisprudence, various aspects of the environment and green crimes have been addressed. At the international level, although there are international agreements on green crimes and extensive regulations, but Islam and the rules and Jurisprudential rulings have covered all aspects of this crime on a much broader level. The following explanation provides complete points about green crime in international documents and jurisprudential rules and principles, and seeks to develop research on green crimes and harms and the environment Have been done and with this description of green crime and its types in Imami jurisprudence and international documents together It has been adapted and the result of this adaptation is that Imami jurisprudence is more inclusive of green crime and its rules have been more effective in preventing the occurrence of this crime than other international documents.
