What ethical stance would be appropriate in today’s messy situation of health crisis, global warming, social and economic antagonisms, etc.? The first one is that of an expert who deals with the specific task imposed on him by those in power, blissfully ignoring the wider social context of his activity. The second one is that of pseudo-radical intellectuals who criticize the existing order from a comfortable morally superior position, well aware that their criticism will have no actual effects. How, then, are we to go on living after we get rid of the illusions of a false critical stance? Not just by accepting our reality: the fascination with the end of our civilization make us spectators who morbidly enjoy the disintegration of normality. A way out of this deadlock is signalled by a line from a song by the German rock band Rammstein: “we have to live till we die”. We have to fight against the pandemic and other crises not by way of withdrawing from life but as a way to live with utmost intensity. Is there anyone more ALIVE today than millions of healthcare workers who with full awareness risk their lives on a daily base? Many of them died, but till they died they were alive.

Background: Ethics are closely tied to people’s beliefs, values, and ideals, and custom assumes a special sacredness for morality. The present study attempts to investigate the role of ethics in civil liability law and the ethical aspects of fault and compensation of damages arising from faults. Through analyzing ethics and its philosophy as well as investigating the ethical theories, the present study also aims to investigate the effects of ethics on civil liability theories. Moreover, by examining the contents of the first part, this study examines the principles of civil liability of the transport operator. Conclusion: Regarding human’s ethical liability, there are two main views in ethical philosophy. First, there is a retrospective view stating that human is responsible for his decision-making power and voluntary actions. Second view is a prospective one holding human responsible for the consequences of his/her actions. Much of the theory of civil liability is inspired by these two views. In the field of transportation, the legal relationship between the sender and the operator of the multimodal transport, under a single contract, is called the multimodal transport contract. The basis of transport operator liability in single-mode conventions is diverse. The basis of liability in The Hague and Warsaw Conventions is based on fault. As for the liability of operators of shipping terminals in international trade (1994), the Hamburg, CMR, CIM, Montreal and the United Nations Conventions are based on presumed liability.

Analysis of science and knowledge from the perspective of evidence to prove criminal cases: Philosophical-ethical study(مقاله علمی وزارت علوم)

تعداد بازدید : ۳۳۹ تعداد دانلود : ۲۵۲
Background: Reason is one of the main elements of criminal proceedings. Historically, criminal justice systems are usually divided into two general types: in the first type, called the "legal evidence system", the reason is only what is stated in the law, and therefore the judge has the right to document his sentence other than It does not have. In the second category, which is called the "system of persuasion of the judge", in addition to the evidence permitted by law, the judge can study other evidence and even evaluate, injure and modify the evidence presented, but the issue that is important and is very important from a legal and moral point of view is the basis of the judge's knowledge and how to achieve it. Therefore, the purpose of this article is to analyze science and knowledge from a philosophical-ethical perspective from the perspective of evidence of criminal litigation to provide the conditions for explaining the knowledge of the judge and ways to achieve this knowledge as the most important evidence of litigation. Conclusion: The knowledge of the judge is one of the positive reasons in criminal cases that obtained as a result of examination, exploration, and investigation of the judge in the referral cases for him. Science can be valid and cited when the reasons for achieving it are legal and in accordance with judicial ethics. Therefore, personal knowledge that does not have a rational and legal basis and origin cannot be a criterion and document for issuing a judge's verdict.

When aesthetics does not lead to an act of environmental conservation(مقاله علمی وزارت علوم)

This paper examines the relationship between the environmental aesthetics approach backed by knowledge (ecological aesthetics) and the possibility of doing an action in favor of environmental conservation. It seems that even having such an approach towards the environment fails to sufficiently motivate people to protect the environment and nature, since there is a tension between the course of daily life and scientifically supported environmental aesthetics. In order to explain such tension, we tend to examine and critique ecological aesthetics (which is in some respects overlapped with environmental ethics) from the viewpoint of the philosophy of Wittgenstein, particularly with reference to his later work including the concept of formal life. Based on this concept, ecological aesthetics can be criticized and examined on three grounds: First, aesthetics is not able to create understanding or appreciation that leads to action. Second, the ecological concept added to reinforce the aesthetics, cannot support aesthetics in this regard and can even make things worse; ecological aesthetics, in fact, diverts aesthetics from its purpose (the purpose with regards to the environment, which is to motivate people to preserve nature) by trying to give it a strong objectivity. Third, the role of ethics in its current form in environmental conservation cannot be an active role.

The Rise of the "Other" and the Fall of the "Self": from Hegel to Derrida(مقاله علمی وزارت علوم)

Since time immemorial, due to its metaphysically grounded perspective, western philosophy has not been able to detach itself from the egoistic outlook, and thus, the interaction with the "other” had no role in this philosophy. The world has always been interpreted from the perspective of "self" ignoring the "other". Reviewing this mode of thought from Ancient Greece to Modern Age, one can reveal a kind of repression and forgetfulness of "alterity" and difference which Levinas has well highlighted in his philosophy. The very foundation of this egoism can be traced back to the Socratic slogan "know yourself”. In the same spirit, a kind of self-centered moral philosophy has been developed, the clear example of which is Kant's ethics. In line with Hegelian tradition of recognition, contemporary thinkers have redefined ethics and politics and acknowledged the constitutional dependence of the “self” on the "other." Based on the coordinates of their thought as well as the historical condition of their own time in the formation of subjectivity, these thinkers have criticized the neglect of the “other”. Hegel's role in underlining the importance of the vital status of the “other” is unique. Hegel bridges all post-Hegelian currents on the concept of “Other”. Then, in the present essay, we seek to show that since Hegel’s time up to Derrida, we have been witness to the rise of “Other” and the fall of “Self”.

“For Others, in Spite of Myself, from Myself”: A Levinasian-Feminist Reading of Charlotte Mary Matheson’s "The Feather"(مقاله علمی وزارت علوم)

When Charlotte Mary Matheson began writing The Feather in 1929, numerous movements regarding women's rights were emerging. However, despite various references to contemporary issues, Matheson’s book initially did not receive much attention from critics; it was only after a few decades that The Feather became one of the best-selling novels, especially in Iran. In this article, a feminist reading of the novel was conducted on the basis of the alterity of the Other and the ethics of the French philosopher Emmanuel Levinas. The common ground between the theories of feminism and Levinasian philosophy is the relationship between the Self and the Other, which according to both theories, needs to change. Traditionally, men were accepted as the dominant power or the Self and women as the second sex or the Other. On the other hand, ethics, according to Levinas, emphasizes a proper relationship between the Self and the Other. Hence, the kind of relationship between the Self and the Other and the alterity of the Other become important; thus, this relationship requires a new definition. This reading of the novel shows how the relationship between the Self and the Other in the story, which begins with carnal desires, eventually ends in a moral one. In addition, the female character rediscovers her independence and identity, which was initially dominated by men.

All human behaviors are ethical if done with the intention and purpose of the nearness of God.
