نقد کمیت گرایی در قانون مبارزه با مواد مخدر بر اساس آموزه های قرآنی

چکیده
پی بردن به شرایط تحقق «افساد فی الارض» با تمسک به آیات قرآن، در حقوق جزا و حفظ نظام اجتماعی تأثیرگذار است. در آیات مرتبط با «افساد فی الارض» و همچنین ماده 286 قانون مجازات، شرایط کیفی همچون گستردگی، استمرار، عادت به عمل ارتکابی و ورود خسارت عمده به تمامیت جسمانی افراد جامعه و به عبارتی، تأثیر گسترده عمل ارتکابی بر روی افراد و جامعه، از ارکان اساسی احراز افساد معرفی می شود. در حالی که قانون گذار در قانون مبارزه با مواد مخدر، کمیت مواد مخدر کشف شده را به عنوان یکی از شرایط احراز افساد در نظر گرفته و بدین طریق، در صدد تفسیر و رفع ابهام از قیود کیفی مذکور می باشد. در این نوشتار با استفاده از روش توصیفی- تحلیلی و با مراجعه به منابع کتابخانه ای و استنباط از آیات قرآنی، این نتیجه به دست آمده است که معیارهای احراز «افساد فی الارض»، کیفی است و معیار قرار دادن صِرف کمیت در قانون مبارزه با مواد مخدر با آموزه های اسلامی سازگاری ندارد.A Critique of the Inclination towards Quantification in the Anti-Narcotics Law Based on Quranic Teachings
investigating the conditions for the realization of " Mufsid fī al-Arz[1](corruption on earth)" based on Quranic verses has a significant impact on criminal law and the preservation of the social system. In the verses related to "corruption on earth" and Article 286 of the Penal Code, qualitative conditions such as prevalence, continuity, habituation to the act of commission, and causing significant harm to the physical integrity of individuals in society—essentially, the extensive impact of the criminal act on individuals and society—are introduced as fundamental elements of identifying an act as corruption. While the legislator in the anti-narcotics law considers the quantity of discovered drugs as one of the conditions for establishing corruption, thus attempting to interpret and clarify the qualitative limitations mentioned. This paper, using a descriptive-analytical method and referring to library sources and deducing from Quranic verses, concludes that the criteria for establishing "corruption on earth" are qualitative, and the sole reliance on quantitative features of an act in the anti-narcotics law is incompatible with Islamic teachings.
