تحلیل اقتصادی برنامه ریزی توسعه در نظام حقوقی جمهوری اسلامی ایران

چکیده
تحلیل اقتصادی برنامه ریزی حقوقی توسعه، مطالعه ای میان رشته ای میان حقوق و اقتصاد است که در آن روش ها و ابزارهای اقتصادی برای بررسی و طراحی برنامه ریزی مطلوب، جهت نیل به توسعه به کار می رود. تحلیل اقتصادی، نگرشی بر ایجاد فرصت و افزایش بصیرت کارگزاران حقوقی ایجاد می کند و «وسیله» در نظر گرفته می شود نه «هدف»، و درجهت تخصیص بهینه منابع جهت برنامه ریزی مطلوب گام برمی دارد؛ ازاین رو، طراحی آن مهم است؛ زیرا با طراحی نادرست به اهداف دست پیدا نمی کنیم. دولت ها اعمال کننده حاکمیت و اقتدار عمومی اند که برنامه ریزی را جهت دستیابی به توسعه، مطابق با قانون اساسی و اسناد بالادستی انجام می دهند. هدف از به کارگیری تحلیل اقتصادی در برنامه ریزی توسعه، شناسایی منطق برنامه ریزی در نظام حقوقی ایران و پیش بینی تعاملات آینده برنامه ریزی است. این مقاله با استفاده از روش توصیفی تحلیلی در پی پاسخ به این سؤال است که تحلیل اقتصادی برنامه ریزی توسعه در سلسله مراتب نظام حقوقی ایران چگونه است؟ و تحلیل اقتصادی چه کمکی به برنامه ریزی توسعه می کند؟ سپس با ابزارهای اقتصادی، ازقبیل کارایی، هزینه فایده، انحصار، رقابت، تعادل و نظریه بازی ها به تحلیل می پردازد. یافته های پژوهش نشان می دهد که تحلیل اقتصادی بصیرت برنامه ریزان را افزایش می دهد و امکان سنجش و مقایسه برنامه های توسعه را جهت دستیابی به بهترین و کم هزینه ترین نسخه مطلوب توسعه که شامل وضع قوانین مختلف است، امکان پذیر می کند و نهایتاً هدف گذاری آینده سهل تر می شود.Economic Analysis of Development Planning within Iran's Legal System
Economic analysis of the development in legal planning is an interdisciplinary study between law and economics in which economic methods and tools are used to examine and design optimal planning in order to achieve development. Economic analysis is an approach to create opportunities and increase the insight of agents. It creates rights and it is considered as means, not a goal. It takes steps towards the optimal allocation of resources for optimal planning. Therefore, its design is important because we cannot achieve our goals with incorrect design. On the other hand, governments, as exercising public sovereignty and authority ; plan to achieve development in accordance with the constitution and upstream documents. The purpose of applying economic analysis in development planning is to identify the logic of planning in Iran's legal system and predict the future interactions of planning. Using the descriptive-analytical method, this article seeks to answer the question what the economic analysis of development planning is in the hierarchy of Iran's legal system and how the economic analysis helps development planning. Then, with employed economic tools such as efficiency, cost - Utility, monopoly and competition, balance and game theory, it will be analyzed. Research findings show that economic analysis increases the insight of planners and the possibility of measuring and comparing development plans in order to achieve the best and least. It enables the most cost-effective version of development (which includes the establishment of various laws) and finally, it becomes easier to set goals for the future.
