بررسی عقد ابضاع از منظر فقه امامیه

چکیده
ابضاع در اصطلاح فقیهان، به معناى سپردن سرمایه به دیگرى براى تجارت است، بدون این که عامل، در سود و زیانِ آن، سهیم یا اجرتى براى او تعیین شود، بر خلاف مُضاربه که عامل، در سود تجارت شریک است. در این مقاله با هدف بررسی مفهوم عقد ابضاع از منظر فقه امامیه، سعی بر آن شده است که ضمن بررسی مفهوم عقد ابضاع، مشخصات عقد مذکور، مستندات مشروعیت آن را تبیین نماید، و از رهگذر این بررسی، ارکان، شرایط تحقق این عقد مشخص شده است.Examining the marriage contract from the perspective of Imami jurisprudence
