چکیده
جلوگیری از تضییع حقوق دیگران، حفظ مال افراد در قرآن کریم و روایات ائمه اطهار بیش از همه امور بر آن تأکید شده است. با توجه به حساسیت این مهم تأکید بر اهلیت و مالکیت در فرایند ثبت و سند درآیات و روایات بسیار به چشم می خورد. درواقع پژوهش های انجام شده نیز در راستای نشان دادن اهمیت مالکیت و اهلیت در مباحث فقهی و حقوقی است. این پژوهش به روش کیفی و کتابخانه ای ضرورت و اهمیت بحث مالکیت و شرایط مهم آن چون اهلیت در ثبت سند را با رویکرد قرآنی موردبررسی قرار می دهد و در انتها مشخص می شود که ثبت، مالکیت به همراه داشتن شرایطی چون اهلیت برای مالک یک ضرورت حقوقی، دینی، شرعی، عقلی و اخلاقی است؛ بنابراین هدف پژوهش حاضر این است که ضرورت منطقی و عقلی اهلیت در ثبت اسناد را از منظر قران مبرهن سازد و به طور دقیق مشخص کند این مصحف شریف چگونه شایستگی لازم اشخاص را برای اهلیت در امور حقوقی به ویژه ثبت سند تبیین کرده است.Jurisprudence and legal review of compliance The principle of eligibility in document registration with the Quranic approach

This qualitative and library research is essential and discusses the ownership and its important conditions because it examines the qualification in document registration with its characteristics and in that Quran it is clear that registration is ownership with conditions such as qualification for registration. The owner is a legal, religious, religious, intellectual and moral issue; Therefore, the purpose of the present research is to prove the logical and rational necessity of qualification in document registration from the perspective of the Qur'an and to specify precisely how this honorable Mushaf has explained the necessary competence of persons for qualification in legal affairs, especially document registration.
