بسترهای قانونی منع خشونت نسبت به زنان در حقوق کیفری ایران

چکیده
امروزه دامنه انواع خشونت آنقدر گسترش یافته که نگرانی اکثر جوامع انسانی را به وجود آورده است. موقعیت حقوقی زنان و حقوق آن ها در هر اجتماعی بهترین شاخص برای ارزیابی جایگاه حقوقی انسان در آن اجتماع است. در بعضی از جوامع، اعمال خشونت نسبت به زنان و دختران اعم از خشونت روحی روانی، خشونت جسمی، خشونت مالی، ریشه در مقررات و قوانین دارد که می توان دلیل برخی از آنها را ایراد در مبانی وضع قانون به دلیل لزوم پیروی از منابع و متون دینی و عدم انطباق آن با واقعیت های موجود در جامعه، مصالح و نیازها و ضرورت های اجتماعی دانست. هدف از انجام این تحقیق بررسی بسترهای قانونی خشونت نسبت به زنان در حقوق ایران است. نوع پژوهش در این مقاله، تحلیلی- توصیفی بوده و با استفاده از ابزار کتابخانه ای انجام شد. یافته ها حاکی از آن است که در نظام حقوقی ایران، پاره ای از مقررات در حقوق مدنی و کیفری و نیز لایحه صیانت، کرامت و تأمین امنیت زن ان در برابر خشونت، واجد حمایت تقنینی از زنان در مقابل خشونت به ویژه خشونت جنسی هستند.Legal Grounds for the Prohibition of Violence against Women in Iran's Criminal Law
Today, the scope of all forms of violence has expanded so much that it has raised the concerns of most human societies. Women's legal status and their rights in any society are the best indicators for assessing the legal status of human beings in that society. In some societies, violence against women and girls, including psychological violence, physical violence, financial violence, is rooted in laws and regulations, some of which can be attributed to the roots of the law because of the necessity of following religious sources and texts and not adapting it to the realities in society, interests, needs and social necessities. The aim of this study was to investigate the legal context of violence against women in Iranian law. The research type in this paper was analytical-descriptive and was conducted using library tools. The findings indicate that in Iran’s legal system, some provisions in civil and criminal rights, as well as a bill to protect women from violence, have legislative protection against violence, especially sexual violence.
